Poland: More laws seem to violate EU law

The EU Commission has today announced treaty infringement procedure against Poland. President Duda has vetoed two laws on judiciary reform but at least a third law seems to violate EU law and the EU treaties according to the Commission. Furthermore, the EU Commission has decided detailed recommendations to the Polish institutions how the judiciary reform has to be adapted in order to make it compliant with the Treaties.


MEP Sven Giegold, EP’s rapporteuer on transparency, integrity and accountability of EU institutions commented:


“The Commission has sent a clear signal to the Polish government without overstepping its legal possibilities. This is good news for the rule of law and European democracy. The independence of the judiciary is an indispensible part of the rule of law and democratic principles.


Nevertheless, the government majority in Poland has enacted more laws which seem to violate EU law. Therefore I have written to Vice-President Timmermans to analyse these laws as well and to consider infringement procedures. The list of potential breaches of EU law is based on work of the Polish legal NGO ‘Frank Bold’.”
