For the report voted Greens, Social-Democrats, Liberals and right-wing Conservatives. The Christian-Democrats voted against the report and isolated themselves. In March, the Constitutional Affairs Committee (AFCO) had already supported the report. Almost all members agreed except for only three German Christian-Democrats who opposed more lobby transparency and tougher integrity rules. More than 1,000 citizens and non-governmental organizations were involved in the preparation of the report. More than 100,000 citizens supported a petition for the report\u2019s key demands. Parliament&#8217;s own-initiative report now needs to be followed by implementation measures by the EU institutions.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\"><strong>Sven Giegold<\/strong>, rapporteur for transparency, accountability and integrity in the EU institutions, as well as Spokesperson for Alliance 90 \/ The Greens in the European Parliament, said:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;It is a great success that the European Parliament consents to significantly greater transparency in lobbying and stronger rules against revolving doors. The European Parliament has taken the front foot on countering the feeling that there is too much closeness between politics and big business. The long struggle for more transparency and strong ethics rules has paid off. By implementing those demands, the EU institutions can now be the pioneer for lobbying transparency.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Legislative Footprint, requested by the European Parliament, will allow citizens to see at a glance who has been able to influence the drafting of EU legislation. The transparency register for lobbyists \u2013 which until now has been voluntary \u2013 will become more binding as lobbyists will have to register in order to gain access to legislators.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Berlin, Paris and other capital cities have weaker transparency rules and should now also follow suit on lobby transparency. Progress in the Parliament makes the Council the last of the three major EU institutions that allow unregistered lobbyists easy access.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">MEPs also rejected the unworthy attempts of MEP Markus Pieper to place European civil society on a very short leash. The Christian Democrats wanted to see a governmental authority evaluate whether organisations base their arguments on verifiable facts. Such an approach may be common in Russia, Cuba or Venezuela, but is unworthy of democracy in Europe.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Today&#8217;s decision has a downside: it is shameful that MEPs want to keep looser standards for themselves than for employees of the EU Commission. The Group chairmen already adopted a mandate for Parliament in these negotiations on a revision of the &#8220;Interinstitutional Agreement&#8221; between Parliament, the Commission and, in the future, the Council of the Member States. The decision, which has now been adopted by the plenary, complements demands both towards the other institutions and Parliament&#8217;s deputies. (See the complete list of changes below.) The two lead negotiators on behalf of Parliament, Sylvie Guillaume and Danuta H\u00fcbner, had already agreed with a swift revision of the mandate after the decision.<\/p>\n<p>Other requests from the original draft report were included in the reform of Parliament\u2019s Rules of Procedure adopted in December 2016. This includes that MEPs should \u201cadopt the systematic practise\u201d of meeting only with registered lobbyists.<\/p>\n<p>The progress made by the report adopted today, in details, is as follows (in brackets you find the paragraphs that refer to the AFCO adopted version, paragraphs in the final version still need to be adapted):<\/p>\n<h3>(I.) SCOPE<\/h3>\n<p>Council\u2019s preparatory bodies to be added (\u00a714 in the Giegold report adopted today)<\/p>\n<p>European External Action Service and informal bodies like the Eurogroup to be added (\u00a754)<\/p>\n<p>Strong call on regulatory EU agencies to commit to the Transparency Register and lobby transparency rules instead of weaker invitation so far (\u00a77)<\/p>\n<p>The main targets of lobbying in the EU, the staff of MEPs and advisers in political groups should be included since \u00a72 calls on MEPs and their staff to ask for registration before meetings and \u00a77 calls on staff in all institutions to refrain from giving\/accepting unregistered lobbyists for patronage, hosting, speaker roles and advisory bodies.<\/p>\n<h3>(II.) FRAMEWORK<\/h3>\n<p>Exceptions for lawyers who lobby in secret by misusing their professional secrecy have to be deleted since \u00a717 insists that registered entities, including law firms and consultancies, should declare in the Transparency Register all clients for whom they lobby.<\/p>\n<p>International organisations to be expected to register as well (\u00a73)<\/p>\n<p>Add a call on Commission to drop in their existing lobby rules the limitation to \u2018bilateral\u2019 lobby meetings (\u00a73)<\/p>\n<h4>(A.) (\u00a74)<\/p>\n<p>Der Rat der Mitgliedstaaten und deren st\u00e4ndige Vertretungen sollen nur registrierte Lobbyisten treffen. (\u00a714)<\/p>\n<p><b>Die Dreht\u00fcr zwischen EU-Kommission und Lobby-Jobs schlie\u00dfen<\/b><\/p>\n<p>Ehemalige Kommissare sollten mindestens 3 Jahre (statt bisher 1,5 Jahre oder wie von der Kommission gestern vorgeschlagen 2 Jahre) warten m\u00fcssen, bis sie Lobbyisten werden d\u00fcrfen. (\u00a730)<\/p>\n<p>Diejenigen, die beurteilen, ob die neuen Jobs ehemaliger Kommissare regelgem\u00e4\u00df sind, sollten unabh\u00e4ngig von den Betroffenen sein statt wie der derzeitige ad-hoc-Ausschusses von der Kommission selbst handverlesen zu werden. (\u00a731)<\/p>\n<p>Eine Abk\u00fchlperiode von 18 Monaten sollte auch f\u00fcr externe und ad hoc-Mitglieder des Regulatory Scrutiny Board im Rahmen einer besseren Rechtsetzung und f\u00fcr Mitglieder des Verwaltungsrates der Europ\u00e4ischen Investitionsbank in Erw\u00e4gung gezogen werden. (\u00a733)<\/p>\n<p><b>Die Integrit\u00e4t der EU-Kommission st\u00e4rken<\/b><\/p>\n<p>Die Rechte und Pflichten der Kommissionsmitglieder sollten in einem EU-Gesetz geregelt werden, das im \u00fcblichen Verfahren von Parlament und Rat der Mitgliedstaaten gemeinsam entschieden wird. Dies sollte die gegenw\u00e4rtige Selbstregulierung der Kommission und den Mangel an Aufsicht durch das Parlaments abl\u00f6sen. (\u00a740)<\/p>\n<p>Die Kommission soll alle Protokolle der Sitzungen von Sachverst\u00e4ndigengruppen (Englisch: expert groups) einschlie\u00dflich der vertretenen Meinungsvielfalt ver\u00f6ffentlichen. Die Gruppen sollen ihr Veto dazu verlieren. (\u00a737)<\/p>\n<p><b>Open government: Leichterer Zugang zu Dokumenten, mehr Transparenz im Rat der Mitgliedsl\u00e4nder<\/b><\/p>\n<p>Trilog-Dokumente sollen auf der Website des Parlaments wie andere Legislativdokumente \u00f6ffentlich zug\u00e4nglich sein. Dies gilt f\u00fcr Tagesordnungen, Zusammenfassungen von Ergebnissen, Protokollen und allgemeinen Ans\u00e4tzen im Rat. (\u00a745)<\/p>\n<p>Der Zugang zu Dokumenten soll leichter werden auch f\u00fcr den Europ\u00e4ischen Rat, die Europ\u00e4ische Zentralbank, den Gerichtshof und alle EU-Organe und -Agenturen indem Verordnung (EG) Nr. 1049\/2001 auch f\u00fcr sie Anwendung findet. (\u00a745)<\/p>\n<p>Der Rat der Mitgliedstaaten soll Dokumente, insbesondere Protokolle der Sitzungen der Arbeitsgruppen des Rates, ver\u00f6ffentlichen, die die Position der einzelnen Mitgliedstaaten kl\u00e4ren. (\u00a745)<\/p>\n<p>Ob EU-Dokumente wirklich geheim sein m\u00fcssen, sollte von einer unabh\u00e4ngigen Beh\u00f6rde zur Einstufung und Freigabe von Dokumenten \u00fcberpr\u00fcft werden. (\u00a745)<\/p>\n<p>Die Gremien, in denen das Parlament seine Agenda bestimmt, sollen ihre Dokumente ver\u00f6ffentlichen: Die Ausschusskoordinatoren, das Pr\u00e4sidium und die Konferenz der Fraktionsvorsitzenden. (\u00a745)<\/p>\n<p><b>Mehr Transparenz und Rechenschaftspflicht in den EU-Handelsverhandlungen<\/b><\/p>\n<p>Dokumente \u00fcber Handelsverhandlungen sollten so \u00f6ffentlich sein wie von der Europ\u00e4ische B\u00fcrgerbeauftragten empfohlen, einschlie\u00dflich Lobby-Meetings, Entw\u00fcrfen von Tagesordnungen f\u00fcr Sitzungen, endg\u00fcltige Tagesordnungen und Berichte nach Verhandlungen. (\u00a749)<\/p>\n<p>Wichtige handelspolitische Dokumente sollten dem Parlament leichter zur Verf\u00fcgung stehen. Dazu geh\u00f6ren die Abgrenzung des Umfangs, Mandate und Entwicklung von Verhandlungen (\u00a750)<\/p>\n<p>Das Parlament sollte mehr \u00fcber die Mandate f\u00fcr internationale Verhandlungen im Vorfeld der internationalen Verhandlungen entscheiden, anstatt nur das zu implementieren, was bereits international beschlossen wurde. Zu diesem Zweck solle die Kommission Leitlinien f\u00fcr die Annahme und Koh\u00e4renz der europ\u00e4ischen Standpunkte im Vorfeld von gro\u00dfen internationalen Verhandlungen einf\u00fchren. Die Kommission sollte f\u00fcr die Vertretung in internationalen Organisationen und Gremien einen Verhaltenskodex f\u00fcr Transparenz, Integrit\u00e4t und Rechenschaftspflicht vorlegen und verwirklichen. (\u00a752)<\/p>\n<p><b>Ethik-Regeln f\u00fcr alle EU-Einrichtungen<\/b><\/p>\n<p>Der Rat und andere EU-Organe oder Gremien ohne Verhaltenskodex sollten solche Ethik-Regeln einschlie\u00dflich Sanktionen einf\u00fchren. (\u00a726)<\/p>\n<p><b>Mehr Transparenz und Rechenschaftspflicht in der EU-Finanzpolitik<\/b><\/p>\n<p>Bislang intransparente Gremien wie die Eurogruppe, der Wirtschafts- und Finanzausschuss, \u201einformelle\u201c Ratssitzungen der Finanzminister (ECOFIN) und Euro-Gipfeltreffen m\u00fcssen institutionalisiert, transparent und rechenschaftspflichtig werden. (\u00a754)<\/p>\n<p>Die Kommission soll einen Gesetzesvorschlag machen, um dem Parlament mehr Mitentscheidung bei der Koordination europ\u00e4ischer Wirtschaftspolitik im Rahmen des Europ\u00e4ischen Semesters einzur\u00e4umen. (\u00a757)<\/p>\n<p><b>Whistleblower verbindlich sch\u00fctzen<\/b><\/p>\n<p>Um Whistleblower (auch: Hinweisgeber) zu sch\u00fctzen, sollte die Kommission umgehend einen Rechtsrahmen f\u00fcr ihren wirksamen Schutz vorschlagen. (\u00a760)<\/p>\n<p>Das Parlamentspr\u00e4sidum soll eine Studie anfertigen, wie Whistleblower unter den parlamentarischen Assistenten besser gesch\u00fctzt werden k\u00f6nnen, obwohl sie automatisch ihre Anstellung verlieren, wenn der ihnen vorgesetzte Abgeordnete ausscheidet. (\u00a759)<\/p>\n<p>Die Kommission soll einen Vorschlag vorlegen, wie das B\u00fcro der B\u00fcrgerbeauftragen als zentrale Anlaufstelle f\u00fcr Whistleblower ausgebaut werden kann, inklusive der n\u00f6tigen Mittelaufstockung. (\u00a762)<\/p>\n<p><b>Vorbeugung gegen Korruption st\u00e4rken<\/b><\/p>\n<p>Die Auswahl von Kandidaten f\u00fcr EU-Wahlen sollte strengeren demokratischen Mindestnormen gen\u00fcgen, beispielsweise der geheimen Wahl und angemessener Mitsprache der Parteimitglieder (\u00a739)<\/p>\n<p>Verurteilte Verbrecher, die der Korruption gegen die finanziellen Interessen der EU oder innerhalb von Mitgliedstaaten schuldig sind, sollen von der Kandidatur f\u00fcr EU-Wahlen ausgeschlossen werden. F\u00fcr solche Disqualifizierungsverfahren, die in einigen Mitgliedstaaten bereits bestehen, wollen wir gemeinsame Mindeststandards festlegen. (\u00a739)<\/p>\n<p>Die EU sollte so bald wie m\u00f6glich Mitglied in der Staatengruppe gegen Korruption des Europarats (GRECO) werden. (\u00a763)<\/p>\n<p>Die EU-Kommission soll den zweiten EU-Anti-Korruptionsbericht ohne weitere Verz\u00f6gerungen ver\u00f6ffentlichen. Das Parlament antwortet damit auf das Schreiben von Kommissar Timmermans, in dem er von seinem Versprechen diesen Bericht vorzulegen, vor kurzem abger\u00fcckt war. (\u00a765)<\/p>\n<p><b>Interessenskonflikte bei wissenschaftlicher Expertise vermeiden<\/b><\/p>\n<p>Zur Vermeidung von Interessenkonflikten und unangemessener Einflussnahme bei Studien, auf denen die EU-Gesetzgebung beruht, sollen z.B. Studien vor der Durchf\u00fchrung registriert werden. Auch falls der Auftraggeber unzufrieden ist, sollen die Ergebnisse dann trotzdem einbezogen werden. Die Kommission soll mehr in eigene Kapazit\u00e4ten f\u00fcr unabh\u00e4ngige wissenschaftliche Gutachten investieren. (\u00a767)<\/p>\n<p><b>Gemeinwohl-Interessen in EU-Beratungsgremien st\u00e4rken<\/b><\/p>\n<p>Experten, die Nichtregierungsorganisationen in EU-Beratungsgremien vertreten, sollen eine angemessene Entsch\u00e4digung erhalten, damit schw\u00e4chere Interessen besser vertreten werden. Dies entspricht der bew\u00e4hrten Praxis der europ\u00e4ischen Aufsichtsbeh\u00f6rden wie z.B. der Europ\u00e4ischen Bankenaufsicht. (\u00a768)<\/p>\n<h3><b>ABGELEHNT<\/b><\/h3>\n<p>Diese Vorschl\u00e4ge waren in meinem Entwurf des Berichts enthalten, aber in den Verhandlungen oder in der Abstimmung nicht durchsetzbar (Auswahl):<\/p>\n<p><b>Keine Karenzzeit f\u00fcr Europaabgeordnete<\/b><\/p>\n<p>Keine Abk\u00fchlperiode f\u00fcr Europaabgeordnete: Sie k\u00f6nnen die Dreht\u00fcr in Lobbyjobs direkt nach dem Ende ihres Mandat nehmen. Europaabgeordnete erhalten zwar ein \u00dcbergangsgeld f\u00fcr je einen Monat pro Jahr, das sie zuvor im Parlament waren, bis maximal zwei Jahre. Wir hatten sowohl f\u00fcr die \u00c4nderung der Gesch\u00e4ftsordnung als auch f\u00fcr die heutige Abstimmung eine Karenzzeit beantragt, in der f\u00fcr die Dauer des \u00dcbergangsgeldes ein neuer Job als Lobbyist verboten sein sollte. Mit einer Mehrheit aus Konservativen und Liberalen wurde eine solche Karenzzeit aber abgelehnt.<\/p>\n<p><b>Lobbytransparenz bleibt bei Abgeordneten Empfehlung statt Pflicht<\/b><\/p>\n<p>Weder Abgeordnete noch Lobbyorganisationen sind verpflichtet, ihre Treffen zu ver\u00f6ffentlichen. Bei der Reform der Gesch\u00e4ftsordnung des Parlaments im Dezember 2016 erreichte unser Antrag f\u00fcr solch eine Pflicht zwar eine einfache Mehrheit, aber nicht die erforderliche absolute Mehrheit, weil die Konservativen und Liberalen dagegen stimmten.<\/p>\n<p><b>Keine Rechenschaftspflicht f\u00fcr die Umsetzung des Verhaltenskodex von Abgeordneten<\/b><\/p>\n<p>Der Ethikausschuss des Parlaments bleibt f\u00fcr eine Erg\u00e4nzung durch externe Sachverst\u00e4ndige verschlossen.
