Scheitern der Geldwäsche-Verhandlungen: Mitgliedsstaaten blockieren Konsequenzen aus den Panama Papers

Heute scheiterte die letzte Verhandlungsrunde (Trilog) zwischen Europaparlament, Rat der Mitgliedsländer und Europäischer Kommission zur 4. Reform der EU-Anti-Geldwäscherichtlinie (AMLD). Das Europaparlament beschloss im Februar 2017 eine starke Position, um Geldwäsche und Steuerhinterziehung zu bekämpfen. Das Europaparlament verhandelt seitdem mit der Maltesischen Ratspräsidentschaft, um eine Verbesserung der EU-Gesetze durchzusetzen.

 

Sven Giegold, wirtschafts- und finanzpolitischer Sprecher und Geldwäsche-Schattenberichterstatter kommentiert das Scheitern der Verhandlungen:

 

“Es ist peinlich, dass die Mitgliedsstaaten nationale Sonderinteressen wichtiger nehmen als den Kampf gegen Finanzkriminalität. Die Lücken bei der Durchsetzung bestehender Geldwäscheregeln sind eine Gefahr für die europäische Sicherheit und begünstigen Steuerflucht.

 

Es ist inakzeptabel, dass Mitgliedsstaaten wollen, dass Trusts schwächer reguliert werden als andere Unternehmen, die vergleichbare Geschäfte in der Vermögensverwaltung machen.

 

Rechtsanwälte, Notare und unabhängige Finanzdienstleister müssen Geldwäscheregeln genauso beachten wie Banken. Die Panama Papers zeigen: Sie müssen strikt und unabhängig beaufsichtigt werden.

 

Der Rat verlangte sogar, die bestehenden Gesetze bei politisch exponierten Personen (PEPs) zu schwächen, so dass etwa die maltesischen Regierungsmitglieder nicht mehr länger verstärkten Sorgfaltspflichten bei der Kundenidentifizierung unterlägen.

 

Die Mitgliedsstaaten weigern sich gar überall Register für Land und Immobilien einzuführen, die ermöglichen würden verstecktes kriminelles Geld aufzuspüren. Großbritannien, Frankreich, Italien und viele andere Mitgliedsstaaten haben nationale Immobilienregister. Die deutsche Bundesregierung weigert sich dagegen zu europäischen Standards zu kommen, obwohl Italien oft beklagt hat, dass der deutsche Immobilienmarkt als sicherer Hafen für Mafiageld dient.

 

Wir werden nun alles tun, um ein besseres Ergebnis unter der kommenden Präsidentschaft Estlands zu erreichen. Die deutsche Bundesregierung sollte mehr tun, um in Europa Finanzkriminalität zu bekämpfen.”
