Alleine am heutigen 16. April haben der Justiz-Ausschuss (JURI), der Verfassungsausschuss (AFCO) und der Petitionsausschuss (PETI) Beschlüsse gegen Schiedsgerichte für Konzerne im EU-US-Abkommen TTIP gefasst.
Während die meisten Ausschüsse mit knapper Mehrheit entschieden, stimmten im PETI-Ausschuss auch die Konservativen gegen ISDS bei insgesamt 25 Stimmen für den Text, 2 dagegen und 3 Enthaltungen.
Der Verfassungsausschuss beschloß auf Grünen Antrag folgenden Absatz innerhalb der Position zu TTIP:
First of all, the alternative compromise we proposed was adopted (against the compromise from the Rapporteur):
ii) Taking into account that the US and EU jurisdictions are not at risk of political interference in the judiciary or denial of justice to foreign investors(AM 22); that an investor-state dispute settlement, based on private arbitration, may undermine the right to regulate in the public interest(AM 24) of the European Union and national, regional and local authorities, regarding in particular social and environmental policies, and would therefore not respect the constitutional framework of the EU; to propose a permanent solution for resolving disputes between investors and states (AM 17), where potential cases shall be treated transparently by professional judges in public trials also allowing lodging at least one appeal (AM 23);
Auf Antrag der französischen Sozialistin Pervenche Berès:
To oppose the inclusion of an ISDS mechanism in TTIP, given the EU’s and the US’s developed legal systems and that a state-to-state dispute settlement system, and the use of national courts are the most appropriate tools to address investment disputes;
Die beiden Absätze müssen noch zusammen gebracht und dann der ganze Beschluss in alle Amtssprachen übersetzt werden.
